Shortmake AI Terms of Use (EULA)
Last updated: October 30, 2026
These Terms of Use (the "Terms") are a license agreement between you and SHORTIA LLC ("we", "us"), the publisher of the Shortmake AI app for iPhone and of the website shortmake.com (together, the "Service"). By downloading, installing or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
1. License
We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the Shortmake AI app on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. You may not copy, modify, decompile, reverse engineer, rent, resell or redistribute the app, except where the law expressly allows it.
2. Your account
You need an account to use the Service (email and password, or Google). Keep your password secret: you are responsible for what happens with your account. You must be at least 13 years old, or the minimum age required in your country to use online services without parental consent.
You can delete your account at any time in the app (Account > Delete my account). Deletion permanently erases your series, videos, characters, remaining credits and what Shorty remembers about you. An active subscription does not stop on its own: cancel it in your Apple account settings.
3. What the Service does
Shortmake AI helps you create short animated series with an AI assistant called Shorty: it writes stories, draws characters and sets, generates video scenes, voices and music, and edits episodes. Results are produced automatically by artificial intelligence. They can contain mistakes, may not match your request exactly and can look similar to content generated for other people. Generation times vary.
4. Credits
Each generation (writing, images, video, voices, editing) uses credits. The cost of a paid step is shown before it starts, and a generation that fails is never charged. Credits included in a subscription are added at the start of each billing period. Credits from a one-time credit pack remain available for 60 days after purchase. Credits have no cash value and cannot be transferred, exchanged or refunded, except where required by law or by the refund policy of the store where you paid.
5. Subscriptions and in-app purchases
The app offers auto-renewable subscriptions (Starter, Creator and Pro, billed monthly or yearly) and one-time credit packs, sold through Apple In-App Purchase. Prices are shown in the app before you buy.
Payment is charged to your Apple Account when you confirm the purchase. A subscription renews automatically for the same period and price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple account settings (Settings > your name > Subscriptions); cancellation takes effect at the end of the current period. Refunds for purchases made in the app are handled by Apple (reportaproblem.apple.com).
If you subscribe on our website instead, payment is handled by our payment provider and you can cancel from your account on shortmake.com.
6. Your content
You keep your rights to what you provide (ideas, text, photos, voice recordings) and, to the extent allowed by law, to the series generated for you. You give us a worldwide, non-exclusive license to host, process, transmit and display this content only to run and improve the Service for you, including sending it to the AI and hosting providers we work with.
You confirm that you have the rights needed for what you upload: in particular, the consent of any person who appears in a photo or whose voice you use, and permission for any protected character, brand or work.
7. Acceptable use
You agree not to use the Service to create or share content that is illegal; sexualizes minors; is sexually explicit; promotes hate, harassment, violence or terrorism; impersonates or deceives others, including realistic depictions of real people without their consent; or infringes someone else's rights. You also agree not to misuse the Service: spam, scraping, attempts to bypass limits or payments, attacks on our systems, or reverse engineering.
We may refuse a generation, remove content, or suspend or close an account that breaks these rules.
8. Third-party services
The Service relies on third-party providers (artificial intelligence, hosting, payments, notifications). When you publish your videos on other platforms such as TikTok, Instagram or YouTube, their own terms apply.
9. Privacy
How we collect and use your data is explained in our Privacy Policy.
10. App Store terms
If you downloaded the app from Apple's App Store, the following also applies:
(a) These Terms are concluded between you and SHORTIA LLC only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
(b) Apple has no obligation whatsoever to provide maintenance or support services for the app. For support, contact us at contact@shortmake.com.
(c) If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent they are not excluded by these Terms.
(d) We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
(e) If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
(f) You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
(g) You must comply with applicable third-party terms of agreement when using the app, for example your wireless data service agreement.
(h) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
11. Disclaimer
The Service is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that it will be uninterrupted, error-free or that results will meet your expectations.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential damages, loss of data, profits or opportunities. Our total liability for any claim relating to the Service is limited to the amounts you paid us in the 12 months before the claim. Nothing in these Terms limits rights that you have as a consumer under the mandatory laws of your country.
13. Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms or if required by law. Sections 6 to 15 remain in effect after termination.
14. Changes
We may update these Terms. The date at the top shows the latest version; if a change is significant, we will let you know in the app or by email. Continuing to use the Service after a change means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. If you are a consumer living in the European Union or the United Kingdom, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings there.
